Tort Claim Filed In Alleged Sex Abuse Case

MEDFORD, Ore — This is an update to a story KTVL CBS News Channel 10 is following. A Klamath Falls student’s lawyer (Tom Petersen) has put the school district and some of its employees on alert that he could file a lawsuit. The student says Kenneth Gardner sexually abused her multiple times. Gardner is a former Junior ROTC instructor for the Klamath Falls School District. Attorney Tom Petersen says the district should shoulder some blame “the incidents involved sexual misconduct on the part of Mr. Gardner with the minor who is a female and it was in a context of the ROTC training and education that the incidents occurred”. A tort claim is a civil action which deals with situations where someone’s behavior has caused harm to another. The Klamath Falls School District isn’t commenting saying it is a personnel issue.

A Rogue Valley attorney (Tom Petersen) announcing that he will file a civil lawsuit against the Klamath County School District and others after he says his client, then a student in the district, was sexually abused by former district employee Kenneth Gardner.
